Terms of Service

These Terms of Service (“Terms”) govern your use of the mobile games published by Pallidor Games (“we”, “us”, or “our”), including any updates and content within them (each a “Game” and together the “Games”), and of our website at https://pallidor.com (together with the Games, the “Services”).

By downloading, installing, or using any of the Services, you agree to these Terms. If you do not agree, please do not install or use the Services.

2. Eligibility

If you are under the age of legal majority in your country, you may only use the Services with the permission and supervision of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your use of the Services, including any purchases.

3. Licence to Use the Games

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to download, install, and use the Games on devices that you own or control, for your own personal and non-commercial entertainment, as permitted by the rules of the app store you obtained the Game from.

The Games are licensed, not sold. We and our licensors keep all rights not expressly granted to you.

4. Acceptable Use

You agree not to:

• Copy, modify, distribute, sell, rent, or sublicense any part of the Services
• Decompile, reverse engineer, or disassemble the Games, except to the extent that applicable law expressly permits this despite this restriction
• Use cheats, bots, automation software, hacks, or any unauthorised third-party software that modifies or interferes with the Games
• Exploit bugs or errors to gain an unfair advantage, or manipulate scores, leaderboards, or advertising
• Interfere with or disrupt the Services, their servers, or networks
• Use the Services for any unlawful purpose or in breach of these Terms

5. Advertising

The Games may display advertisements provided by third-party advertising partners. We are not responsible for the content of third-party ads, or for any products, services, or websites they promote. Your dealings with advertisers are solely between you and the advertiser.

How advertising and analytics data is handled is described in our Privacy Policy.

6. In-App Purchases

Some Games may offer optional purchases, such as removing ads or unlocking content. Purchases are processed by the app store you use (for example, Google Play or the Apple App Store) and are subject to that store’s terms and payment policies. We do not receive or store your payment details.

• Virtual items and currency have no real-world monetary value, cannot be exchanged for cash, and are licensed to you under these Terms rather than sold.
• Refund requests are handled by the app store in line with its refund policy.
• Where purchased content is delivered immediately, you agree to its immediate delivery and acknowledge that, to the extent permitted by law, you lose your right of withdrawal once the delivery has begun.

Nothing in this section limits any rights you have under applicable consumer protection law if purchased content is faulty or not delivered as described.

7. Intellectual Property

The Services, including all code, graphics, artwork, sound, music, text, characters, names, and logos, are owned by Pallidor Games or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not use them except as permitted by these Terms.

8. Feedback

If you send us ideas, suggestions, or other feedback about the Services, you agree that we may use it freely, without any obligation or compensation to you.

9. Third-Party Services

The Services may include or link to services provided by third parties, such as app stores, analytics providers, and advertising networks. Your use of those services may be subject to their own terms and privacy policies, and we are not responsible for them.

10. Updates and Availability

We may update, change, suspend, or discontinue any Game or feature at any time, for example to fix bugs, add content, or meet legal or technical requirements. Some updates may be required to keep using a Game. We do not guarantee that the Services will always be available or free of interruptions.

11. Disclaimer

To the maximum extent permitted by applicable law, the Services are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

If you are a consumer, nothing in these Terms affects your statutory rights, including your rights under the laws of the European Union and Portugal regarding the conformity of digital content and digital services.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Pallidor Games will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data, profits, or goodwill, arising from or related to your use of the Services.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, for wilful misconduct or gross negligence, or for any other liability that cannot be excluded or limited under applicable law.

13. Termination

You may stop using the Services at any time by uninstalling the Games. We may suspend or end your licence to use the Services if you seriously or repeatedly breach these Terms. Sections 7, 11, 12, and 15 continue to apply after termination.

14. Additional Terms for Apple Devices

If you downloaded a Game from the Apple App Store, the following also applies:

• These Terms are between you and Pallidor Games only, not with Apple Inc. (“Apple”). Pallidor Games, not Apple, is solely responsible for the Game and its content.
• Your licence to use the Game is limited to Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
• Apple has no obligation to provide any maintenance or support services for the Game.
• If the Game fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of the Game. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Game.
• Apple is not responsible for addressing any claims by you or any third party relating to the Game, including product liability claims, claims that the Game fails to conform to any legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
• If a third party claims that the Game or your use of it infringes their intellectual property rights, Pallidor Games, not Apple, is responsible for the investigation, defence, settlement, and discharge of that claim.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, Apple has the right to enforce them against you.

15. Governing Law and Disputes

These Terms are governed by the laws of Portugal. If you are a consumer living in another country, you also keep the protection of any mandatory consumer laws of your country of residence, and you may bring a claim in the courts of that country.

If you have a complaint, please contact us first at pallidor@pallidor.com and we will try to resolve it. Consumers in Portugal may also use an alternative dispute resolution entity. A list of these entities is available at www.consumidor.gov.pt.

16. General

• These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Services.
• If any part of these Terms is found invalid or unenforceable, the remaining parts stay in full effect.
• If we do not enforce a right under these Terms, that does not waive the right.
• You may not transfer your rights under these Terms. We may transfer ours to another organisation, as long as this does not reduce your rights.

17. Changes to These Terms

We may update these Terms from time to time, for example to reflect changes in the Services or in the law. When we do so, we will update the “Last updated” date at the top of this page. If a change is significant, we will make reasonable efforts to let you know, for example within the Game. Continuing to use the Services after the changes take effect means you accept the updated Terms.
